Terms and Conditions

These terms are written in plain language. They describe what SendOff Kenya does and what we ask of you when you use it.

1. Acceptance of these terms

By downloading or using the SendOff Kenya mobile app or this website (together, the "Service"), you agree to these Terms and Conditions with Redbarn Information Security Ltd ("we", "us"). If you do not agree, please do not use the Service. Our Privacy Policy explains how we handle your information and forms part of these terms.

2. The service

SendOff Kenya is a mobile app for the small committee that organises a funeral in Kenya. It gives the committee one place to keep track of its people, tasks, budget, contributions, pledges, expenses, meetings and communications, from forming the committee to the final financial review and closing the event. It complements WhatsApp and M-Pesa rather than replacing them: conversation stays in WhatsApp, money moves through M-Pesa or however your committee chooses, and SendOff Kenya is the coordination and the record.

We may add, change or remove features as the app develops.

3. Your account

You need an account to use the app. You can create one with your name, email address and a password, or sign in with Google or Apple. An email account must be verified before it can be used. You must be at least 18 years old to create an account.

You are responsible for keeping your sign-in details secure and for everything that happens under your account. Give us a real name: it is shown to the other members of your committee and is attached to every record you create. One account can belong to as many events as you are invited to.

4. Committees and roles

The person who creates an event becomes its Chairperson. The Chairperson invites people by email, chooses their role (Treasurer, Secretary or Committee Member), can change roles, remove members and adjust what each role may see and do. The Chairperson alone can close an event, and can hand the Chairperson role to another member. If a Chairperson cannot be reached, we can hand the role to another current member at the committee's request; this is recorded in the event's history.

Invitations are sent to the email addresses the Chairperson enters. Only invite people who have agreed to help organise the funeral, and only enter information about other people (the person who has died, contributors, the people you pay) that you are entitled to share with your committee. Each member sees what their role allows; a contributor who asks to remain anonymous is shown by name only to the Chairperson, Treasurers and Secretaries.

5. Money is recorded, not handled

SendOff Kenya does not take, hold, move or pay out money. It has no connection to M-Pesa, banks or any payment service, and it never asks for card or M-Pesa details. Contributions, pledges and expenses in the app are records that committee members type in. The app's totals are only as accurate as those records, and it is the committee's responsibility to keep them accurate and to reconcile them with the money actually received and spent.

SendOff Kenya is not accounting software and nothing in it is financial, legal or tax advice.

6. Your content

You keep ownership of everything you enter into SendOff Kenya. By using the Service you grant us the limited licence we need to store that content, back it up, and show it to the members of your committee according to their roles, and on a public page if a member creates a public link to a Daily Brief. That is all we do with it.

Because the app exists to keep a funeral's records complete and its finances transparent, some things work differently from other apps, and you agree to them by using the Service:

  • Financial records cannot be deleted, by anyone. A mistaken record is corrected by editing it or marked as void with a reason, and its history stays visible to members who may see history.
  • Every record shows who created or last changed it and when. If a member is removed or deletes their account, the records they created stay with the event under their name.
  • A closed event is read-only for every member and cannot be reopened. Nothing in it is deleted.

What you share out of the app, into WhatsApp or anywhere else, is your responsibility. A public link to a Daily Brief can be read by anyone who has the link until it is switched off or the event is closed.

7. Acceptable use

You agree not to misuse the Service. In particular, you will not:

  • Use the Service for any unlawful purpose, or to record information about other people that you have no right to record.
  • Send invitations to people who have not agreed to take part, or use the invitation feature to send unwanted email.
  • Enter records you know to be false, or use the app to misrepresent a funeral's finances.
  • Attempt to gain access to events you are not a member of, to other people's accounts, or to our systems.
  • Interfere with or disrupt the operation of the Service.

8. Cost

SendOff Kenya is free to download and use. There are no purchases or subscriptions inside the app. If that changes in future, we will tell you in advance and nothing will be charged without your clear agreement.

9. Intellectual property

The Service, including its design, code and branding, belongs to Redbarn Information Security Ltd and is protected by applicable intellectual property laws. These terms do not give you any rights to our name, trademarks or branding.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted or error-free, that it will always be available, or that it is fit for any particular purpose. The app needs an internet connection to work. We are not responsible for the accuracy of what committee members record, for decisions taken on the basis of those records, or for money that is received, spent or lost outside the app.

11. Limitation of liability

To the maximum extent permitted by law, Redbarn Information Security Ltd will not be liable for any indirect, incidental, special or consequential loss or damage arising from your use of the Service, and our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited by law.

12. Termination

You can stop using the Service and delete your account at any time from the app's Profile screen; see the data deletion page. If you chair an active event you will be asked to hand that role to another member first, so the committee is not left without one. We may suspend or end your access if you breach these terms, with notice where reasonably possible.

13. Governing law

These terms are governed by the laws of England and Wales, and any dispute will be resolved in the courts of England and Wales.

14. Changes to these terms

We may update these terms from time to time. When we do, we will update the date at the top of this page and, for significant changes, tell you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated terms.
